My brother just bought an ACER N30 and its got mutch better version of Pocker PC 2003 PRo than I have on my IPAQ.  Could I use his CD to install a newer version of the opsystem on my older device?

It would be highly unlikely that this would work or that the installation would even start.  In reality, even if it started to flash the ROM on your iPAQ, it would fail part way through and then your PDA would be dead!  The vendors tweak Windows Mobile/Pocket PC to their devices.  For example a ROM flash for an iPAQ 3600 won't even work on an iPAQ 3850 let alone across brands.  Aside from the fact that it would be a violation of the license agreement (i.e. illegal).
